Terms of Service

1. Acceptance of Terms

By accessing or using FreshSeeing ("the Service"), operated by Transmission Technologies AS, organization number 934179757 ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using FreshSeeing, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms of Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

3. Description of Service

FreshSeeing is an AI-powered conversational platform designed to facilitate self-inquiry, reflection, and personal insight. The Service uses artificial intelligence to engage users in conversations across various gateways of exploration.

Important: FreshSeeing is not a substitute for professional mental health services, therapy, or medical advice. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

4. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and current

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Use the Service for commercial purposes, including reselling access, scraping content, or building competing products based on the Service, without our prior written authorization. Note that personal and professional use of insights gained through the Service, including use within coaching practices with healthy individuals, is permitted and encouraged. FreshSeeing is not a therapeutic or clinical tool and should not be used as such
• Share content that is illegal, harmful, or violates the rights of others

6. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Transmission Technologies and protected by intellectual property laws.

You retain ownership of content you create through the Service. By sharing fragments to the Collective Consciousness, you grant us a non-exclusive, royalty-free license to display that content anonymously to other users within the Service. By releasing fragments to the Field, you additionally grant us a non-exclusive, royalty-free license to use that content in promotional materials, social media, and other marketing efforts to showcase the depth and insight generated by our community. You may retract shared fragments at any time, which will remove them from future display, though we cannot guarantee removal from content already published or distributed.

7. Community and Insight Stream

FreshSeeing includes a video-first community feature called the "Insight Stream." By participating in the community, you agree to the following terms:

7.1 Community Profile

To participate, you must create a community profile with a unique display name. Your display name, bio, and profile photo are publicly visible to all community members. You are responsible for ensuring your profile does not contain misleading, offensive, or inappropriate content.

7.2 Video Content Guidelines

You agree that videos you upload will not contain:

• Nudity, sexually explicit, or pornographic content
• Violence, gore, or content glorifying harm
• Hate speech, harassment, or bullying
• Content that infringes on others' intellectual property rights
• Spam, misleading content, or deceptive practices
• Content that violates any applicable laws
• Personal information of others without their consent
• Content promoting illegal activities or substances

7.3 Video Ownership and License

You retain ownership of videos you upload. By uploading a video to the Insight Stream, you grant Transmission Technologies a non-exclusive, worldwide, royalty-free license to host, store, stream, display, reproduce, and distribute your video content for the purpose of operating the Service.

For public videos, this license extends to displaying your content to other users. For private videos, we only use this license to store and display the video to you. You may revoke this license at any time by deleting your video.

7.4 External Sharing

Public videos can be shared outside of FreshSeeing via shareable links. By making a video public, you acknowledge that:

• Any community member can share your public video's link externally
• Anyone with the link can view your video, regardless of whether they have a FreshSeeing account
• Your display name will be visible as the video author
• You cannot control who shares your public videos or where they are shared
• Making a video private will block access via previously shared links

We are not responsible for how community members or third parties share or distribute public video content.

7.5 Community Conduct

When interacting with other community members, you agree to:

• Treat others with respect and kindness
• Not harass, bully, or intimidate other users
• Not post comments that are hateful, threatening, or abusive
• Not impersonate others or misrepresent your identity
• Report content that violates these guidelines

7.6 Moderation and Enforcement

We reserve the right to:

• Remove any content that violates these terms or community guidelines
• Suspend or terminate accounts that repeatedly violate guidelines
• Take action against users who abuse the reporting system
• Modify these community guidelines at any time

Content removal and account actions are at our sole discretion. We are not obligated to provide specific reasons for content removal or to restore removed content.

7.7 AI Processing of Your Videos

By uploading videos to the Insight Stream, you acknowledge and agree that your video content will be processed by artificial intelligence systems for the following purposes:

• Transcription: Automatic generation of captions from your video's audio
• Categorization: Analysis of content to assign topics and categories for organization and discovery
• Recommendations: Identification of themes to recommend related videos to other users
• Rabbit Holes: Creation of thematic pathways connecting related videos for deeper exploration

This AI processing is essential to the community experience and cannot be disabled for individual videos. If you do not wish your content to be processed by AI, please do not upload videos to the Insight Stream.

AI-generated transcriptions, topics, and categories are provided "as is" and may contain errors. You can edit auto-generated captions for your own videos.

8. AI-Generated Content

The Service uses AI to generate responses. While we strive for helpful and accurate responses:

• AI responses should not be considered professional advice
• We do not guarantee the accuracy or completeness of AI-generated content
• Users should exercise their own judgment when acting on AI responses
• AI responses may occasionally be inappropriate or incorrect
• Factual assertions in AI-generated outputs should not be relied upon without independently checking their accuracy, as they may be false, incomplete, misleading, or not reflective of recent events or information

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Payments and Subscriptions

Payments for subscriptions and credit purchases are processed by Creem.io, our Merchant of Record. When you subscribe or purchase credits, you will be redirected to Creem's secure checkout page to complete your payment. Creem handles all payment processing, billing, tax compliance, and refunds on our behalf.

By making a purchase, you agree to Creem's Terms of Service and Privacy Policy. Creem receives your email address and payment information to process transactions. We do not store your payment card details.

Subscriptions renew automatically at the end of each billing cycle. You may cancel, pause, or resume your subscription at any time from the Subscription page. Bonus credits purchased as one-time top-ups do not expire and persist until used, even if your subscription is cancelled.

If you are unsatisfied with a paid subscription, you may request a refund within 14 days of purchase by contacting support@freshseeing.com. Refunds are processed by Creem.io on our behalf. EU/EEA consumers retain statutory withdrawal rights in accordance with applicable law. Creem.io also reserves the right to process refunds within 60 days of purchase to prevent chargebacks, in accordance with their policies.

In accordance with applicable consumer protection legislation, we will send active subscribers an annual reminder of their subscription, including the current price and instructions for cancellation.

We may reach out to subscribers who appear inactive to remind them of their option to pause or cancel. We will not send more than one such reminder per period of inactivity.

10.1 Founding Members

Founding members receive complimentary access to the Resting plan for the lifetime of their account, including all future updates and improvements to that plan, for as long as the Service operates and their account remains active. Features introduced as part of plans above Resting are not included in founding member access. Founding member status is personal and non-transferable.

While we commit to honoring this promise, please note that in the event of service discontinuation, Transmission Technologies AS cannot guarantee ongoing access beyond the point of discontinuation. In the event of acquisition or restructuring, we will make reasonable efforts to ensure founding member benefits are honored by any successor entity, but cannot contractually guarantee this outcome.

10.2 Price Changes

We may adjust subscription prices from time to time. If we do, we will notify you by email at least 30 days before the new price takes effect, clearly stating the current price, the new price, and the date the change applies. You may cancel your subscription at any time before the effective date if you do not wish to continue at the new price. Continued use of the Service after the effective date constitutes acceptance of the updated price. Subscribers receiving a discount will continue to receive their discount applied to the then-current subscription price. This does not affect any additional rights you may have under applicable consumer protection law.

10.3 Discount Codes

Discount codes may be issued as part of affiliate, referral, or promotional programs. Discounts are applied to the then-current subscription price unless explicitly stated otherwise. Only one discount code may be applied per subscription. Discount codes are personal and non-transferable unless otherwise specified.

11. Limitation of Liability

To the maximum extent permitted by law, Transmission Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your content
• Any AI-generated responses or recommendations

Nothing in this limitation of liability affects your statutory rights as a consumer under applicable law, including rights under Norwegian consumer protection legislation and EU consumer protection directives where applicable.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time. For paying subscribers, we will provide a minimum of 30 days notice before any full service discontinuation, and will issue pro-rata refunds for any unused paid subscription period. For free users, we will make reasonable efforts to provide advance notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service beyond the obligations stated herein.

14. Changes to Terms

We may update these Terms of Service from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. If you do not agree with the changes, you may terminate your account before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms. For founding members, no change to these terms will reduce or eliminate your founding member benefits without your explicit consent.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway. We both agree to submit to the non-exclusive jurisdiction of the Norwegian courts for resolution of any disputes arising under these terms. If you are a consumer resident in the EU/EEA or another jurisdiction with mandatory consumer protection laws, nothing in this clause affects your right to bring claims before the courts of your country of residence or to benefit from the mandatory consumer protection provisions of your local law.

16. Account Deletion

You may delete your account at any time through the account settings. Upon deletion, all your personal data, conversations, fragments, videos, and community content will be permanently deleted in accordance with our Privacy Policy.

Founding member status is tied to your account and cannot be transferred or reinstated following account deletion. Active paid subscriptions should be cancelled before account deletion — any remaining subscription period will not be automatically refunded upon account deletion unless requested within 14 days.
